JAM Training Oy (“us”, “we”, or “our”) operates the Spoonful of Awesome Parenting mobile application and  website (the “Services”).

This page informs you of our policies regarding the collection, use, and disclosure of personal data when you use our Services and the choices you have associated with that data.

We use your data to provide and improve the Services. By using the Services, you agree to the collection and use of information in accordance with this policy. Unless otherwise defined in this Privacy Policy, terms used in this Privacy Policy have the same meanings as in our Terms and Conditions, accessible from 

Definitions

Personal Data means data about a living individual who can be identified from those data (or from those and other information either in our possession or likely to come into our possession). ​

If you are located outside Finland and choose to provide information to us, please note that we transfer the data, including Personal Data, to Finland and process it there.

JAM Training Oy will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your Personal Data will take place to an organisation or a country unless there are adequate controls in place including the security of your data and other personal information.

Disclosure Of Data

Disclosure for Law Enforcement

Under certain circumstances, JAM Training Oy may be required to disclose your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).

JAM Training Oy may disclose your Personal Data in the good faith belief that such action is necessary to:

JAM Training Oy aims to take reasonable steps to allow you to correct, amend, delete, or limit the use of your Personal Data.

Whenever made possible, you can update your Personal Data directly within your account settings section. If you are unable to change your Personal Data, please contact us to make the required changes.

If you wish to be informed what Personal Data we hold about you and if you want it to be removed from our systems, please contact us.

In certain circumstances, you have the right:

  • To access and receive a copy of the Personal Data we hold about you

  • To rectify any Personal Data held about you that is inaccurate

  • To request the deletion of Personal Data held about you

You have the right to data portability for the information you provide to JAM Training Oy. You can request to obtain a copy of your Personal Data in a commonly used electronic format so that you can manage and move it.

Please note that we may ask you to verify your identity before responding to such requests.

Service Providers

We may employ third party companies and individuals to facilitate our Services (“Service Providers”), to provide the Services on our behalf, to perform Service-related services or to assist us in analysing how our Services are used.

Analytics

We may use third-party Service Providers to monitor and analyse the use of our Services. ​

Google Analytics

Google Analytics is a web analytics service offered by Google that tracks and reports mobile application and website traffic. Google uses the data collected to track and monitor the use of our Services. This data is shared with other Google services. Google may use the collected data to contextualise and personalise the ads of its own advertising network.

Our Services may contain links to other sites that are not operated by us. If you click on a third party link, you will be directed to that third party’s site. We strongly advise you to review the Privacy Policy of every site you visit.

We have no control over and assume no responsibility for the content, privacy policies or practices of any third party sites or services.

Children’s Privacy

Our Services do not address anyone under the age of 18 (“Children”).

We do not knowingly collect personally identifiable information from anyone under the age of 18. If you are a parent or guardian and you are aware that your Child has provided us with Personal Data, please contact us. If we become aware that we have collected Personal Data from children without verification of parental consent, we take steps to remove that information from our servers.

Changes To This Privacy Policy

We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page.

We will let you know via email and/or a prominent notice on our Services, prior to the change becoming effective and update the “effective date” at the top of this Privacy Policy.

TERMS AND CONDITIONS FOR THE USE OF SERVICE

1.1 Service Description and Acceptance of the Terms and Conditions

Spoonful Of Awesome Parenting (hereinafter the ”Service”) is an application (App) developed and maintained by JAM Training Ltd (hereinafter the ”Service Provider”). The App is compatible with Apple iOS devices, Android OS devices and other devices and environments that enable use of the Service. The Service Provider is not responsible for any support, maintenance or servicing related to the Service. The Service, its functionality and/or features may vary according to the compatibility of the device and environment used, network connection and format of the content.

By using the Service or tapping on the ”Accept Terms and Conditions” box, the user indicates that (s)he accepts these Terms and Conditions. Users shall read the Terms and Conditions carefully before accepting them. If the user does not want to undertake to comply with these Terms and Conditions, (s)he shall immediately stop using the Service. The Service Provider may change the Terms and Conditions of the Service at any time without advance notification, by updating this document. The Service Provider has the right to terminate provision of the Service and the user’s Service use at any time, by issuing a notice of termination.

1.2 Limitation of Liability and Disclaimer

The Service contains information on matters related to health and illness. This information is not intended to be a medical, health care or other licensed professional’s advice nor to be considered the practice of medicine or health care. The material and information included in the Service are only for informational purposes.  The user is responsible for the use and application of the Service and reliance on any information provided therein. The Service is not intended to be used as a substitute for professional medical or health care advice, treatment or diagnosis. The Service shall not be used to substitute any professional medical or health care service or consultation either. The contents of the Service may not be used if they contradict the instructions or information given by a maternity clinic, physician or other health care professional. The user is advised to always seek the consultation of a medical professional with any questions regarding her medical condition as soon as possible and not to rely on the information provided in the Service. The Service Provider is not responsible for the accuracy of the information, advice or instructions presented in the Service, nor may any claims against the Service Provider be made based on them.

The Service Provider is not responsible for any use of the Service, inaccuracy or incompleteness of information presented in the Service, the erroneous functioning of the Service, unavailability of or disruptions to the Service, or any direct or indirect, incidental, special or consequential damage incurred by the user due to any other reason. The Service Provider does not guarantee the uninterrupted, timely or error-free availability of the Service.

The Service Provider issues no warranty for the Service or the information or matters presented therein. The Service is provided ”as is” and ”subject to availability”. The Service Provider is not responsible for the Service’s suitability for the user’s purposes. The Service Provider is not responsible for any damage, losses or changes caused to the user’s devices by installation or use of the application that enables the use of the Service.

1.3 Intellectual Property Rights and License

The contents and design of the Service are protected under the Copyright Act. All information, materials, functions, layouts and other contents of the Service are the Service Provider’s property protected by the Copyright Act.

The user is only permitted to use the Service and its contents for the user’s own, non-commercial purposes. The copyrights for the Service and the material made available through it belong to the Service Provider. The unauthorized use and copying of images and text protected by copyright is forbidden. The Service Provider does not license any of its copyright protected material under these Terms and Conditions or any other express or tacit agreements, unless expressly in writing stated otherwise. All rights are reserved by the Service Provider.

The user has the right to copy or share the contents of the Service or a part thereof to persons who are not current users via the Service and by no other means. The user does not have the right to distribute, disseminate or publicly present the Service or its contents, as it is or in a modified form, nor otherwise make the Service or its contents available to the public. The user may not use the Service unethically or in violation of these Terms and Conditions or the law.

All trademarks and trade names of the Service Provider included in the Service are trademarks or registered trademarks of the Service Provider. These trademarks shall not be used in any manner without an express written consent from the Service Provider.

1.4 Use of Personal Data and Protection of Privacy

The Service Provider will handle and store user information and other customer information in an appropriate manner. The processing of personal data is described in greater detail in the Service Provider’s description of file.

1.5 Indemnification

The user agrees to indemnify, defend and hold harmless the Service Provider, its officers, directors, employees, agents, licensors and suppliers from and against all losses, liabilities, expenses, damages and costs, including reasonable attorneys’ fees, resulting from any violation of these Terms and Conditions or any use of the Service against these Terms and Conditions or reliance on any information made available to the user when using the Service.

1.6 Severability

If any current or future provision of these Terms of Service is found invalid, void or for any reason unenforceable, that provision is severable and does not affect the validity and enforceability of any remaining provision of these Terms and Conditions.

1.7 Surviving Provisions

The provisions relating to limitation of liability and disclaimer, intellectual property rights, indemnification and jurisdiction and applicable law shall survive the termination of these Terms and Conditions and the termination of the use of the Service.

1.8 Jurisdiction and Applicable Law

These Terms and Conditions shall be governed by the laws of Finland without giving effect to any principle of law which would result in the application of laws of any other jurisdiction. Any controversy, dispute or claim arising out of these Terms and Conditions or use of the Service that cannot be amicably solved shall be settled in public courts in Finland, with the District Court of Helsinki as the court of first instance.
